Creating an assessment step by step

The assessment wizard is at Check your brand name in the app. It has four steps, and you can go back and edit anything until you press the final button.

The four ways to start one

The wizard is the same in every case; only how much of it is pre-filled changes.

From the assessment page

Check your brand name in the navigation opens an empty wizard. Use this for a name you have not searched yet.

From search results, without selecting anything

Press Assess in the results toolbar. The wizard opens pre-filled with your query, countries and classes, and Demarka picks the relevant marks from the result set itself — you are not expected to triage a list of 200 hits before you can order a report.

This is the normal route, and the one to use unless you have a specific reason not to.

From search results, with marks selected

Tick the marks you care about and press Use for assessment. The analysis then works from your selection instead of choosing for itself.

Use this when you already know which hits matter — for example after filtering to live marks in your own classes — or when you want to force attention onto a mark you consider dangerous.

Selecting nothing is not the worse choice; it just delegates the shortlist. Selecting is for when you disagree with what an automatic shortlist would contain.

Open Searches and use the ⋯ menu on any row → Start assessment. The saved query, countries and classes carry over. This is the route for a search you ran days ago: saved searches never expire, whereas a live result set is cached for about an hour.

Step 1 — Brand

Brand name (required). The exact wording you intend to file.

Logo (optional). Drag and drop a PNG, JPG, WebP or GIF up to 10 MB. A logo is worth adding: it can add distinctiveness to a name that is weak on its own, and the analysis takes it into account.

Report language. The report itself can be written in any of 20 languages, independent of your interface language — Chinese, Czech, Danish, Dutch, English, Finnish, French, German, Italian, Japanese, Kazakh, Korean, Polish, Portuguese, Russian, Slovenian, Spanish, Swedish, Turkish and Ukrainian. Choose the language of whoever will read the report.

Step 2 — Markets

Applicant origin — the country you are filing from. This is pre-filled from your location and matters more than it looks: it affects whether geographic elements in your mark read as origin-suggestive or as misleading.

Which territories to check (required) — one credit each.

Two behaviours to know:

  • Selecting all 27 EU member states collapses automatically into European Union — single assessment (1 credit): one report for an EU trademark covering all 27, instead of 27 reports. A link lets you opt back out and assess each member state separately.
  • You cannot enter registry codes such as EM or WO as territories. They are added to the search automatically; as an assessment target, use the European Union option instead.

Step 3 — Classes

Two modes, switched by a link:

  • Browse classes — select from the grid, then write a short business description (required): one or two sentences on what you actually sell.
  • Guided — the class helper asks about your business and proposes classes, which you then review.

The business description is not decoration. It is read by the analysis to judge whether your name is descriptive of your goods and how closely earlier marks overlap with what you do. Write it properly.

Step 4 — Review and order

A summary of everything, each row editable inline: brand name, countries, classes, logo, language and business description.

Press Get the verdict to order. Reports are generated in the background; you will get a notification when each one is ready.

Your marks — sometimes called excluded marks

This step also holds an optional Your marks section, where you declare trademarks you already own so they are treated as your prior rights rather than as obstacles against you. Without it, your own earlier registration is reported as a conflict with your own application.

If you do not have enough credits

A dialog tells you how many are needed and how many you have, and offers the cheapest credit pack that covers the gap, the full pack list, or a plan comparison. Your draft is preserved — after buying, you land back in the wizard with everything still filled in.
